8 Driving Rules You May Not Realise You’re Breaking

by Lawrence Hart | Blog

Many motorists drive safely every day without realising that some
everyday habits could land them with a fine, penalty points, or even
prosecution. Some offences are well known, while others regularly catch
drivers by surprise.

At Lawrence’s Driving School, we believe safe driving is about more than
passing your test. Understanding the rules of the road helps you stay
safe, protect other road users, and avoid unnecessary penalties.

1. Wearing Headphones While Driving

There is no law that specifically bans wearing headphones while driving.
However, if they distract you from what’s happening around you or
prevent you from hearing important sounds such as emergency vehicle
sirens, your driving could fall below the required standard.

Police can prosecute drivers whose control of the vehicle or awareness
is affected, with penalties ranging from fines and penalty points to
more serious offences if dangerous driving is involved.

**Top tip:** Keep distractions to a minimum. If you need navigation or
hands-free calls, ensure they never reduce your awareness of your
surroundings.

2. Throwing Litter From Your Vehicle

Discarding rubbish from a vehicle isn’t just inconsiderate—it can be
expensive. Local authorities have powers to issue fixed penalties, and
in some cases the registered keeper of the vehicle can be held
responsible.

Keeping a small rubbish bag in your car is a simple way to avoid
temptation.

3. Using the Wrong Child Seat

Children must use an appropriate child car seat until they reach the
legal height or age requirements, unless a specific exemption applies.

Using the wrong seat—or failing to secure it correctly—can result in
fines and, more importantly, significantly increases the risk of injury
in a collision.

Always check: – The seat is suitable for the child’s height and
weight. – It is correctly installed. – The harness is properly adjusted
every journey.

4. Vaping While Driving

Vaping behind the wheel is not specifically illegal. However, large
vapour clouds can temporarily obscure your vision and distract you.

If your driving is affected, you could still be prosecuted for driving
without due care and attention.

If you choose to vape, pull over somewhere safe first.

5. Driving While Tired

Fatigue can affect your reactions as much as alcohol.

If you’re struggling to keep your eyes open, yawning repeatedly or
finding it difficult to concentrate, the safest option is to stop
somewhere safe and take a break.

Planning longer journeys with regular rest stops can dramatically reduce
the risk of fatigue-related collisions.

6. Driving in Unsuitable Footwear

Although there is no list of banned footwear, you must always be able to
operate the controls safely.

Footwear that can easily slip off or restrict pedal control—including
some flip-flops, sliders or very high heels—may increase the risk of
losing control.

Choose footwear that gives good grip, supports your foot and allows
precise pedal control.

7. Eating or Drinking Whilst Driving

Having a quick sip of water or coffee is not automatically illegal.

However, if eating or drinking distracts you and your driving standard
falls, you could face prosecution for careless driving.

If you’re particularly hungry or need to eat a meal, it’s always safer
to stop first.

8. Giving Way to Pedestrians

The Highway Code places greater emphasis on protecting vulnerable road
users.

Drivers should take particular care around junctions, crossings and
pedestrians waiting to cross. Good observation, anticipation and
patience are essential for safe driving.

Safe Driving Starts With Good Habits

Many driving offences happen simply because motorists don’t realise they’re breaking the rules. Developing good habits early not only helps you avoid penalties but also makes you a safer, more confident driver.
